KINGSTON – According to clerks in the Ulster County courts, the dates by which the judge will be rendering a decision on whether or not to hear the lawsuit between Shop-Rite and Walmart have been pushed back to September and December. The decision regarding the nullification of the negative declaration issued by the Town of Wawarsing Planning Board — which is also named as a defendant in the lawsuit — is due by September 8. A decision regarding whether or not depositions of witnesses and discoveries will be permitted for use in the case is due by December 8, said the clerk this week.
